  • The Court of Appeal’s upcoming judgment in EntwistleHelliwell is expected to help answer the essential question arising from the law of nuptial agreements, being: what is a “predicament of real need”?
  • The judgment is also expected to address the impact of defective financial disclosure on the validity of a nuptial agreement
  • This session will consider what the judgment means for litigating contentious nuptial agreements, and for best practice in drafting them
  • The case achieved notoriety after Francis J at first instance criticised the husband’s budget for seeking £26,000 per year for a “meal plan”. The judge told him to learn to cook an omelette. For the sake of clarity and to avoid disappointment, delegates will be responsible for their own breakfast: no omelettes will be cooked during the session…

Speaker Biographies

Nicholas Bennett described by Chambers and Partners  as “the go-to barrister for prenuptial agreements”. Nick drafts agreements; reviews those drafted by others; and litigates divorce cases which concern them. The nature of Nick’s practice means that the identity of his clients is strictly confidential; but he acts for a wide range of business leaders, celebrities, aristocratic and landed families and other wealthy individuals. He is also instructed on behalf of businesses and trustees wanting to put in place common guidelines for nuptial agreements for their staff or beneficiaries.

Jack Clitheroe is a Partner in the Forensic Accounting team at BTG Advisory.  He has specialised in forensic accountancy for over a decade and spent 11 years at a “big four” firm. Jack has led a variety of forensic assignments including matrimonial and contentious business valuations (both as Single Joint Expert and single-party expert), quantification of business interruption and loss of profit, commercial disputes, transaction disputes and investigations of allegations of fraud and other financial irregularities. Jack has delivered training to legal and finance professionals on business valuations, quantifying lost profits, fraud prevention and detection and effective investigation of allegations of fraud in the UK and across Europe.

District Judge Sheren Guirguis was appointed on 8th November 2021 to Liverpool Civil and Family Court to sit as a Family District Judge.  She is authorised to deal with complex matrimonial finance cases. As a barrister, she practised from Exchange Chambers, Liverpool, dealing with all aspects of family finance, including financial remedy, cohabitee claims and claims under the Inheritance (Provision for Family and Dependants) Act.

Sam Hillas KC is a financial remedy silk at St Johns Buildings based in Liverpool, an Inner Temple Bencher, Attorney General of the Northern Circuit, an FLBA committee member and on the Financial Remedies Journal editorial team.   She is a member of the group of practitioners and judges headed by His Honour Stuart Farquhar reporting to the President of the Family Division about aspects of financial remedies practice, including transparency.  Sam’s practice takes her up and down the country appearing before courts at all levels and she is well known for her lectures, seminars and podcasts on both financial remedy work and legal practice generally.  She is a qualified arbitrator and regularly acts as a private FDR evaluator.

Liam Kelly

Margaret Parr specialises in family law and has appeared in the Court of Appeal and High Court. She represents parents, children and Local Authorities in care and adoption proceedings. In private law proceedings, Margaret represents parents and children and is experienced in dealing with intractable contact disputes, implacable hostility and international relocation. Margaret acts in ancillary relief proceedings, including those involving pensions and company assets.
